Perfume Scams: Are You a Victim?Last week, a client called my office and requested a meeting about a lawsuit he was considering. He was extremely upset about the situation he was in, and he wanted to meet with me right away. I haven t been practicing law for the last few months, but I agreed to see him, mostly out of curiosity. He came to my home office and we sat down to talk. He told me about this company called A.T.R. Management here in Houston, and about how they misrepresented a job and told hundreds of other lies. We ll call him Brad. His story goes something like this: Brad was looking for a job in the Houston area, and came across an advertisement that read: General office. No exp. nec. New ofc. needs mgmt. help. Will train, then gave a phone and fax number. He answered the ad and was greeted on the phone by a young woman, who asked a little about his management experience, then invited him in for an interview. He was told that the office was seeking managers-in-training to help with a brand new expansion. They said that they were opening more than 20 offices in the Houston area, and that they needed to staff those locations. He was told that they were a perfume distribution company, and that there was no selling involved. And there the horror began for Brad. He ended up walking the streets of Houston with a bag filled with knock- off perfume and cologne, trying to pass them off as the real thing. In a little over four weeks on the job, he made a whopping $55.50, and he was never compensated for gas and hotels, as he was told. He only stayed so long because they had told him that after training was over, they would give him his own office. This was all a fabrication. It turns out that A.T.R. Management is a distribution center which markets rendition fragrances manufacturered by World Perfume, Inc., which is in Carrollton, Texas. Since everyone signs independent contractor agreements, liability is a fuzzy issue, and the distribution center owners lie through their teeth to get bodies out on the streets with their products. Contractors are encouraged to lie to potential customers, and are told that they will be reimbursed for gas and hotel bills on road trips every weekend. It isn t until you wind up in another city that you find out that you are responsible for all of your expenses. How do these people continue to operate? And how do they get away with lying to people?
